    1. What is construction hierarchy?

    Construction classification is the grouping of construction projects based on certain criteria according to legal regulations.

    Pursuant to Clause 2, Article 5 of the 2014 Construction Law (amended and supplemented by Clause 3, Article 1 of the 2020 Amendment to the Construction Law), there are regulations on construction work levels as follows:

    - The level of construction works serving the management of construction investment activities according to the provisions of the Construction Law 2014 is determined based on the criteria of importance, scale, technical specifications of the project and including levels: special level, level I, level II, level III and level IV.

    - Particularly for construction projects serving construction design, it will be regulated in standards and technical regulations. In addition, the construction level serves the management of other contents, which are carried out in accordance with relevant laws.

    Accordingly, the decentralization of each current construction project is carried out according to specialized regulations and relevant legal regulations.

    2. Levels of housing projects in Vietnam

    Housing projects will include apartments and individually built houses. Based on regulations on construction decentralization, housing projects in Vietnam will be divided into the following levels:

    • Special housing projects: with a total floor area greater than or equal to 15,000m2. If determined based on height, it will be greater than or equal to 30 floors;
    • Level 1 housing projects: have a total floor area from 10,000m2 to less than 15,000m2. If determined based on height, it will be from 20 floors to 29 floors;
    • Level 2 housing projects: have a total floor area from 5,000m2 to less than 10,000m2. If determined based on height, it will be from 9 floors to 19 floors;
    • Level 3 housing projects: have a total floor area from 1,000m2 to less than 5,000m2. If the height is determined, it will be from 4 floors to 8 floors;
    • Level 4 housing projects: have a total floor area of ​​less than 1,000m2. If determined based on height, it will be small or equal to 3 floors.

    In addition to the above classification, the project level will be determined based on criteria such as:

    • The importance and scale of the project
    • Scale of project structure

    3. Regulations on classification of housing projects

    Construction competency certificate is one of the important certificates for individuals and organizations operating in the construction field. This will be the conditions and powers that help individuals or businesses legally participate in construction activities. Regulations on decentralization of housing projects in the management of construction activities have been specified through the following laws and decrees:

    • Decree 62/2013/ND-CP

    Regulations on the classification of housing projects will be based on the general principles in QCVN-03-2012-BXD. Based on the latest regulations, housing projects will be classified into level 1, level 2, and level 3.

    Construction works are decentralized for many different purposes. More specifically, based on Clause 1, Article 3 of Circular 06/2021/TT-BXD, the decentralization of construction works is applied as a basis for managing the following construction investment activities:

    a) Determine authority when appraising feasibility study reports; Appraise or give opinions on technology for construction investment projects using technology restricted from transfer or construction investment projects with potential negative impacts on the environment that use technology under the Transfer Law. technology; Appraisal of design implementation after basic design; Check the acceptance work during the construction process and upon completion of construction work;

    b) Classification of construction activities capacity of organizations and individuals to issue capacity certificates and construction practice certificates;

    c) Identify works that are exempt from construction permits;

    d) Determining projects that must compete for architectural plans according to the provisions of Clause 2, Article 17 of the Law on Architecture;

    d) Identify projects that require separate technical instructions;

    e) Identify projects that have a major impact on safety and community benefits;

    g) Identify projects that require mandatory professional liability insurance;

    h)  Identify projects that require periodic assessment of construction safety during use;

    i)   Decentralization of construction work incidents and authority to resolve construction work incidents;

    k) Management of construction investment costs;

    l)  Determine the term and level of project warranty;

    m)  Identify projects for which maintenance procedures must be established;

    n) Other contents according to the provisions of law on construction investment management.”

    5. Principles for determining current construction levels

    Pursuant to the provisions of Article 2 of Circular 06/2021/TT-BXD, there are specific regulations on the principles for determining current project levels including:

    The first principle, relating to criteria for determining construction levels:

    - Criteria for importance and capacity scale are applied to each independent project or a combination of projects or a technology line including many items of a construction investment project according to types of works specified in Appendix I issued with Circular 06/2021/TT-BXD (hereinafter referred to as Appendix I);

    - Structural scale criteria applied to each independent project of a construction investment project according to structure type are specified in Appendix II issued with Circular 06/2021/TT-BXD (after This is collectively referred to as Appendix II).

    The second principle is that the construction level of an independent project is the highest level determined according to the provisions in Appendix I and Appendix II.

    If an independent project is not specified in Appendix I, the construction level is determined according to the regulations in Appendix II and vice versa.

    Third principle, the construction level of a complex of works or a technological line consisting of many items is determined according to the following regulations:

    - In case the complex of works or technological line includes many items specified in Appendix I, the determination of the construction level is carried out according to Appendix I;

    - In case a complex of works or technological lines includes many items not included in Appendix I, the level of the works is determined according to the level of the main work (belonging to the complex of works or technological lines) that has The highest level, the level of the main structure, is determined according to the second principle.

    Fourth principle, the construction level of existing works being repaired, renovated, and upgraded is determined according to the following regulations:

    - In case of repair, renovation, or upgrade that changes the criteria for determining the construction grade in the first principle, the construction grade of the construction after repair, renovation, or upgrade is determined according to the following principles: above mentioned rules;

    - In other cases, the construction level of the project before and after repair, renovation and upgrading remains unchanged.

    4. Contractor's housing construction conditions

    Not all contractors are allowed to participate in the construction field. To operate residential construction, contractors need to meet the following conditions:

    • Have a business registration certificate or a decision to establish an enterprise from a state agency;
    • The content in the registration for a construction capacity certificate is consistent with the content in the business registration or decision to establish an enterprise;
    • Individuals holding key roles need to have a labor contract with the organization requesting a certificate of construction activity capacity;
    • The organization's construction activity capacity certificate will only be valid for 5 years. Within 20 days from the date of change or the certificate expires, procedures for re-issuance must be carried out as soon as possible.

    Conditions for issuance of construction capacity certificates have been prescribed by the Ministry of Construction. This will be the right basis for individuals to compare their abilities and qualifications before applying for a construction competency certificate.
