    1.  Application for housing construction permit

    Number of documents: The investor must prepare 02 sets of documents.

    According to Clause 1, Article 95 of the 2014 Construction Law, an application for a housing construction permit includes:

    - Application for construction permit;

    - Copies of documents proving land use rights;

    - Construction design drawings;

    Drawing of the construction site on the land plot at a scale of 1/50 - 1/500, accompanied by a construction location diagram.
    Drawings of floor plans, facades and main sections of the building at a scale of 1/50 - 1/200.
    Foundation floor plan scale 1/50 - 1/200; and foundation cross section at 1/50 scale with connection diagram of the rainwater drainage system; Wastewater treatment, water supply, electricity supply, information ratio 1/50 - 1/200.
    - For construction projects with adjacent structures, there must be a written commitment from the investor to ensure safety for the adjacent structures.

    2.  Order and procedures for submitting applications for housing construction permits

    Pursuant to Article 102 of the 2014 Construction Law, to receive a construction permit for a house, the homeowner needs to take the following steps: 

    Step 1: Submit documents to the district People's Committee where you are preparing to build a house and want to apply for a construction permit.

    Step 2: The dossier receiving department checks the dossier. If the dossier is not complete, ask the land user to add additional documents. If the dossier is complete, write a receipt and give it to the user. land. 

    In case further consideration is required, the construction permit-issuing agency must notify the land user in writing of the reason, and at the same time report to the authority with direct management authority to consider and direct implementation.

    Step 3: After that, the land user goes to the dossier reception location according to the time stated in the receipt to receive the results and pay the prescribed fee. The land user receives a construction permit accompanied by a design dossier stamped by the construction permit-issuing agency or a written response (in case of ineligibility for a construction permit).

    3. Processing time for applications for housing construction permits

    According to Point e, Clause 1, Article 102 of the 2014 Construction Law, the time for processing applications for housing construction permits is prescribed as follows:

    - From the date of receipt of complete and valid documents, the agency competent to issue construction permits must review the documents to issue a permit within 15 days for individual houses in urban areas; 10 working days for rural houses.

    - In case the permit issuance deadline is due but further consideration is needed, the construction permit-issuing agency must notify the investor in writing of the reason, and at the same time report to the competent authority to directly manage it. review and direct implementation, but not more than 10 days from the expiration date.

    4. Cases where housing construction permits are exempted

    Pursuant to Clause 30, Article 1 of the 2020 Amended Construction Law, the following cases are exempt from construction permits, specifically:

    - Individual houses with a scale of less than 07 floors belonging to urban area construction investment projects, housing construction investment projects with detailed planning of 1/500 approved by competent state agencies ( In this case, the time of commencement of construction must be announced).

    - Individual houses in rural areas with less than 07 floors and in areas without functional area construction planning, urban planning or detailed planning for construction of rural residential areas have been approved by the agency. competent state approval.

    - Individual houses in mountainous areas and islands in areas without urban planning or functional area construction planning.
